Owning a home in the DFW Metroplex is one of the biggest investments you’ll make — and protecting that investment means having the right documents in place before you need them. Here are five documents every DFW homeowner should have professionally notarized.
1. Durable Power of Attorney (Financial POA)
A Durable Power of Attorney gives a trusted person the legal authority to manage your financial affairs if you become unable to do so. For homeowners, this is especially critical — if you’re incapacitated, someone needs to be able to pay your mortgage, handle insurance claims, and make financial decisions on your behalf. Without a notarized POA, your family may need to go through a costly court guardianship proceeding.
2. Healthcare Power of Attorney and Advance Directive
A Healthcare POA designates who makes medical decisions for you. An Advance Directive (living will) documents your end-of-life wishes. These documents must be notarized to be legally valid in Texas. Hospitals accept them immediately when presented correctly — without them, medical staff must make decisions without your input or family guidance.
3. Warranty Deed and Title Documents
If you’ve ever refinanced, added a spouse to the title, or transferred property, your deed must be properly notarized and recorded with the county clerk. An incorrectly executed deed can create title defects that surface years later — during a sale or refinance — and can be expensive to fix. Keep a certified copy in a safe place.
4. Last Will and Testament
A will must be witnessed and notarized to be a self-proving will in Texas — which means the court can accept it without requiring witnesses to testify at probate. Without a self-proving will, settling your estate takes longer and costs more. A mobile notary can come to your home to notarize your will at your convenience.
5. Home Equity Loan Documents
Home equity loans and HELOCs require a full notarized signing package. Texas has specific constitutional requirements for home equity transactions — any error in the notarization process can affect the validity of the lien. Always use a certified Loan Signing Agent familiar with Texas home equity law.
